Welcome, and thank you for being here. These terms explain who I am, what you can expect when you buy from me, and how my images may be used. I've tried to keep them in plain language rather than legal fog.

Throughout these terms, "I", "me" and "my" refer to SagaVortex Art Photography, and "you" refers to you as a visitor or customer.

What these terms cover

These terms apply when you browse this website and when you buy a print or other product from me. By using the website, you agree to them.

For commissioned photography — portrait sessions and event coverage — separate terms apply. See "Commissioned photography" below.

I may update these terms from time to time. The version published here at the moment you place an order is the version that applies to that order.

My images and copyright

Every photograph on this website is my own work. I own the copyright to all images, text and design on this site, and my work is protected under the Dutch Copyright Act (Auteurswet) and international copyright law.

You may not copy, reproduce, download, crop, edit, republish, sell or use any image from this site — commercially or otherwise — without my written permission. This includes use on social media, blogs, print, merchandise, and as training data for machine learning or AI systems.

If you'd like to use one of my images for something, please just ask: sagar@sagavortex.art. I'm generally happy to talk about licensing, and I'd much rather have the conversation than find my work used without credit.

Free wallpapers

Wallpapers offered to newsletter subscribers are for your own personal use on your own devices. Please don't redistribute, share the download link publicly, or use them commercially. If a friend would like a set, send them to sagavortex.art so they can subscribe for their own.

Buying a print

Prints are made by hand

Each print is produced and signed by me personally after your order is placed. Because of this, small natural variations in tone and finish are part of the work rather than a defect. Colours may also appear slightly different on screen than on paper, since every monitor renders colour differently.

Orders

Your order is a request to buy. A contract is formed once I confirm your order by email. If I can't fulfil an order — for example a production problem or an obvious pricing error — I'll let you know and refund you in full.

Prices and payment

Prices are shown in euros and include Dutch VAT where applicable. Shipping is calculated at checkout before you pay. Payment is taken at the time of ordering through Squarespace's secure checkout — I never see or store your card details.

Customers outside the EU may be charged import duties or local taxes on delivery. These are set by your country, not by me, and are your responsibility.

Delivery

Prints are shipped from the Netherlands. Because each piece is made to order, please allow production time in addition to transit time; estimated timings are shown at checkout. Delivery dates are estimates, not guarantees.

If your order arrives damaged or doesn't arrive at all, I'll replace it free of charge — see my Returns & Refunds policy.

Returns

You have 30 days from delivery to return a print, and EU consumers have a statutory 14-day right of withdrawal. Full details, including how to return and who pays return postage, are in my Returns & Refunds policy, which forms part of these terms.

What you can do with a print you've bought

When you buy a print, you own that physical piece. You're welcome to display it in your home or workplace, gift it, or resell that individual print.

Buying a print does not transfer copyright. You may not photograph or scan it to reproduce further copies, use it in commercial or promotional material, or produce derivative works from it.

You're very welcome to share a photo of the print on your wall on social media — a tag or credit is always appreciated, never required.

Commissioned photography

For portrait sessions, event coverage and other commissioned work, the General Terms and Conditions of DuPho (Dutch Photographers) apply, alongside anything specifically agreed in writing between us. These cover assignments, usage licensing, payment and force majeure. You can read them here, and I'll always send them with a quote.

In short: unless we agree otherwise in writing, I retain copyright in the images I create, and you receive a licence to use them for the purpose we agreed.

Using this website

Please use this site lawfully, and don't attempt to disrupt it, gain unauthorised access to it, or scrape or harvest its content — including automated collection of images.

This site may link to other websites. Those aren't under my control, and I'm not responsible for their content or practices.

Availability and liability

I do my best to keep this website accurate and running smoothly, but I can't guarantee it will always be available or entirely free of errors, and it's provided as it is.

Nothing in these terms limits your statutory rights as a consumer. In particular, your legal right to receive goods that match their description and are of satisfactory quality is unaffected.

Beyond that, my liability is limited to the amount you paid for the relevant order, except where liability cannot be excluded by law — including liability for death or personal injury, or for intent or gross negligence on my part.

Privacy

I handle your personal data in line with the GDPR. Please see my Privacy Policy for what I collect and why.

Governing law and disputes

These terms are governed by Dutch law. If we ever have a disagreement, please email me first at sagar@sagavortex.art — in my experience almost everything can be solved with a conversation.

If we can't resolve it, the dispute will be submitted to the competent court in the Netherlands. As a consumer, you also retain the right to bring proceedings in the courts of your own country of residence, and you may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
